Non competition clauses
Standard fare in most buissness sales, and as I've seen applied to employees: no working at the trade your former employer paid to train you in within the employers service area. Only waiver to that that I have heard of was the employee wanted to start his own shop after working for somebody for 10 years and he reimbursed the former employer for all training cost, travel expenses, and pay while training. Talk about overhead on a startup. My take, If the employer pays for training,employer owns the training,same as the wrench and truck.If the employee takes the time and spends his own money on the training,he owns the training.0 -

Sounds odd to me too. I can see non competition clause with a high payed CEO who has access to company secrets ? But to a worker trying to support his family ?
The paper only protects the guy who wants you to sign , not the signer..

thanks for the support i figured i'de be getting a ear full but i know all the short timers and if i make people enbarassed of being in the tradesi need some time to find out what trade there in cause to do this stuff right and take pride in everything you do as if it was in your home lookin at it everyday you got to have a mental promblem considering what happens in the white collor jungle on the other side of the fence at least we have fun and break balls and all kidding aside take pride in things and wonder what's happening to our trades and craftmanship are they all just a thing of the past i hope not i see alot of young guys getting out of the business wanting easier jobs ,who knows i can only guess as to what and how you get good help out of all the years i've been doing this one partner of mine not a helper mind you got it now he's still with that same company one of there top mech well versed in just about everything and worth more than he get paid so for maybe 20 helper you only might get one that gets it it 'sjust a crap shoot peaceR.A. You can't find good help anymore...we can't find help at all. Seems that most younger lads are going into computers or management. Even eletricians can get guys. Today no one wants to work too hard. They want the big bucks and want to take the shortest route to it(and it is usually the longest way around). Our local union have no ...as in non...apprentices. The ones we do see are hungover or coming down and miss quite a few days per month. But it all might be a blessing in disguise. No new guys...shortage of men...too much work...well then the price goes up.0 -

This thread has stirred up a lot of good information.
One thing I have failed to see in this whole issue is:
What are the consequences:
To a Comany that makes a bad choice ... then finds out to late?
To the new hiree that screws up royally and walks of because now he's "not happy" ?
To the customer who thought they found reliable, trusted repair person?
To the trade in general because of -as Dan calls them "knuckleheads"?
When a person lies on their application .. who really knows? So they get canned. They just go next door and do it all over again!
When a guy gets fired for poor or unsafe workmanship .. How does that person suffer for their actions? They just go next door and do it all over again!
It is usually their last employer who suffers!
The way I see it no one is made to atone for their actions (stupidity) because .. THERE ARE NO CONSEQUENCES for the offender!!
Non comp clauses don't work. It is virtually impossible for ANYONE to prevent another person from earning a living.
AND -- since the employer is busy trying to prevent further problems with the business -- who has time or money to work through the legal system?
What this industry needs is some type of registry where these deadbeats can be identified and singled out. Then an only then these people will realize there aint no free ride out there.
Why should we who take pride in our work and trade be made to suffer consequences as a result of actions WE are almost powerless to control?
What are we operating? A babysitting centre for spoiled wannabees?

so why
are you only looking at the YOUNGER guys??? some of us that are a litle older and wiser, still have plenty to offer. but because we are a little older, the younger guy wins and gets the job, then you complain that you can't find good help.
another thing I have found is that most employers pay the same rate for someone less experienced. I have seen guys that had a jouneyman license that didn't know anything (except for what was on the test), and got the same pay as another that knew his stuff. does that seem fair?? I don't think so.
this trade in the last decade has been promoted with "butt crack" knuckleheads, and the general public thinks we make huge money. thats just not true.
better promotion with less "butt crack" advertising is what we need in this feild, maybe that would attract the better workers.
