It all depends on your AHJ and the directions of the manufacture of the Dw/appliance/fixture.

About the indirect WH being 140 to kill leigonella and having a mixing valve on it....is this an IPC thing or a local thing or a mfg recommend thing? Would like to educate customers as I see them. Maybe ME could just post a link to his story...that should be enough to make sure you're safe!!

the anti scald devise is code...
even though something may become code in the future and it has yet to be adopted by the AHJ in your area,...you still should do it right apply for a wavier and suggest that the manufacturers did not spend millions of dollars to get the pieces manufactured listed and approved for someone to arbitraily disregard the current code....
as a standard you wold be better off waiting for the codes to catch up with you rather than the other way around. the 140 is maybe wonderful however i like hot water...0 -
