As for the Fox News report, it just shows once again that the consequences of lawsuits here should be the same as they are in the EU, i.e. that the loser pays all legal fees, including those of the opposing council. Only then will frivolous lawsuits like this be a thing of history.

    With or without merit, these things frequently take on a life of their own. If it's successful can you imagine the impact, even if you only consider the Teflon trimmed valves that are out there?

    Some lawyer may now link us to teflon tape use in potable water systems.
    Although, it can't be as bad as frying pans, right?

    The issue is a bit more complicated...

    ...this lawsuit seems to be centered around some of the manufacturing processes that go into making teflon. The idea being that one obscure chemical that goes into the manufacturing of Teflon will continue to harm people even after manufacturing is complete.

    I don't know all the details of the chemistry behind making teflon, but it is entirely possible that the objectionable chemical is completely gone by the time the manufacturing is complete. Just because the chemical is dangerous and goes into the product, it doesn't mean that the product is dangerous.

    It's a bit like making a cake. I wouldn't recommend eating raw eggs due to the widespread Salmonella contamination of the poultry stock. Yet, once the eggs have been cooked in the cake, they're perfectly safe.

    So I wouldn't worry just yet. I just wish that contingency lawyers had a greater risk hurdle to overcome than just their lost time and expenses.

    not to be smart but

    Isn't it getting to the point where you can't use, do, say or think because it will either kill you, cause you harm or god know's what...It's almost to the point where I can sue because I breath air....I agree with other's, if you sue and you lose you should pay the other person's expense.

    All true, but keep one thing in mind...

    These kinds of lawsuits and at this magnitude have some credentials.

    1) Lawyers like this work on retainer, not hourly rates. They typically get all expenses plus 1/3 of the judgement/settlement.

    2) Lawyers capabale of a billion dollar plus lawsuit have certain expectations that research has suggested they have a reasonably good shot at collecting, since theri payinhg for all the expenses and administration of the suit.

    3) The lawyers know DuPont is a major player who will fight to the death having more lawyers on staff than most big law firms. To tackle that in-house, on staff pack of wolves is not for the faint of heart, yet they see enough merit to do it.

    4) Fundamental principal of suing, "Don't sue somebody bigger than you unless you have the goods. All the goods."
