12 percent would make sense if they actually took care of billing.

It is NOT legal!
At least not in NJ where all charges must be itemized.
It is a blatant violation of NJ Consumer Fraud Statutes and is a criminal action.
I would suspect it is also illegal in most states.
I would ask them if they minded it being run by the Consumer Protection Agency of your state - or the A.G.'s office, before you sign it.
Bet they ask you to hold off until their attorney has a chance to "review" it.

If you bill it, it counts on your taxes. Will you get $ 4 $ deduction when the money is paid out?
Tell them to send out the bill to the cust for the 12.5%
Like someone said, you have to do it at normal rates, so you eat the cost, and have to declare it on taxes.

I am amazed that every post seems to think that it's only 12.5 percent more you have to charge. Last time I checked my office does not run for free. Tracking this and paying out the kickback costs your company time and money. What would you rather be doing? This kind of paper shuffling or doing work that sound's like you enjoy more. Only you can decide and none of us here can make the final choice for you. After all your the one that has to deal with the choice you make. Good Luck.0 -

12.5 % is a partnership,he doesn't get half of that for selling a property. Remind him to get contractors insurance if ther is a lawsuit he will be involved.This sounds like you want this deal but the % is too high.Talk to him and bring it down to say 5%.I walk from these guys.I had guys going out and giving estimates and calling me to do the job fork over 250=300 dollars to them.More of them told me how much I could get outof a sale.I don't charge old rich people more money because they have it.They stand in the shadows and whisper go higher but when something goes wrong you are out in the cold.Another idea send him a letter like Our company policy is a 2.5% finders fee is issued after payment has been made.0 -
