What is the highest temperature would you heat a 40 gal indirect, and mix down to 120*F, and why?

The very highest?
The limitation is your heating medium. If you are running 180F you can usually get your domestic to within 20 degrees of that. If you are running a Viessmann, it tops out at 167 but I know it can make 140F comfortably.
That said, getting the water to 140 F. is all you need to do to kill Legionella, but mix-down for scald control of course as you note.0 -

do have maxium operating temperatures listed by the manufacturers. And the higher the operating temperature the higher the losses. 210F relief valves are installed on most DHW vessels.
