Programable thermostats in NY?

all of NYS since 2002 adapted the energy code.
I think next week I'll order myself a hard copy of the code.
I just found it, section 403.1 requires setback stats based on time of day.
Check the link, in residential section 403.7 it states outdoor reset on boilers.

Digital T-stat
Does any one know where I can find NYS code or NYS Energy code on thermostat requirements? I can't find it in Mechanical code book.
Someone had told me you need at least one programmable t-stat. I don't think that is correct, but they do have to be digital (no mercury)

NYS has adopted a seperate energy code the code has everything from stats to insulation the NYS web site has most of it there

I checked
the code, and cant find anything on stats.
But I did find, interesting that all boilers in NY must have a modulating control base on outdoor temps. Did not know that outdoor reset was mandatory.

It does list programable stats NYS adopted the IBC almost word for word. Outdoor reset is only 500,000BTU and above I think. When I get a min I will find section for the stat code
