  • New DOT regulations as of 7/5/06

    Hey all,

Can someone shed some light on the new NYS DOT regulations for commercial vehicles 10,000 lbs or greater ?

One of my students brought it to my attention last night , and I was wondering if any of the wallies has more info on this. It was said that commercial vehicles used for business purposes over 10,000 gvw must display NYS DOT #'s now .

    Thanks

    Same in NH

The company I work for in NH is following the same DOT law's. Any vehicle registered over 10,000 lbs must follow commercial regulations (60 hour law, 8 hour down time). One other thing to keep in mind is actual weight. You may register under but weigh over and if something occur's you will be responsible for it (the driver and the company!!).

    Dot

2005 PHCC trade show in Mass, a State Trooper told me the regs for my 12,000 Box.

    1) Dot inspection certificate but do not need an actual number unless you cross state lines or travel over 100 miles one way.

    2) Do need health card.

    3) Must stay within the right two lanes on the highway.

    DOT

Evening! Also,"Bill of Laden"must be in the cab of the truck(a list of ALL "HazMat" items on board plus quantity of each) and all HazMat items (refrigerants, acetelyn, oxygen,Gerry Cans, etc) MUST be properly secured). If not secured properly it is a 300$ fine per container-5 freon cylinders= 1500$. Safe driving to ALL,and may DOT be on the other side of the road.

Is that Gross combined or Gross weight

As most 200 series trucks and vans have gross combined weight limits of about 12 to 14,000 lbs. My Ford E250 has a payload of about 3,000 lbs and total combined weight, including trailer, of about 13,000.

    State Vs. Federal

Unfortunately the State(s) have there own rules, as well as the feds. The state patrol has told us alot of the same things, but anytime you cross state lines it becomes a federal concern.
  • DOT Regulations

    Ok Got The Poop !

New York has now enacted a regulation that is part of the US Department of Transportation Safety Administration's MOTOR CARRIER IDENTIFICATION REPORT.

Any commercial vehicle used for business purposes that is 10,000 GVW or more must apply for a DOT Number. This is recorded weight on your NYS registration. This law became in affect on July 5 2006. The application is free as well as the DOT number you will be issued , and you must display this # your are issued on both sides of the vehicle, contrasting color to vehicle and must be visible from 50' away in daylight (minimum of two inch high letters is recommended). The application and # is free , and must be renewed every two years. The painting or applying of vinyl # is the owner/operator's resonsibility. You do not recieve a physical sticker , we must pay for the lettering or vinyl design and installation.
The new regulation applies to all commercially registered vehicles in New York State. Oh and by the way .... you must have your business name on the vehicle too!
Trailers towed behind trucks are added to the vehicles weight that is towing it , so the truck and trailer combined weight if over 10,000 GVW must be registered with DOT. If the trailer is less than 10,000 GVW alone but combined truck and trailer weight is 10,000 GVW or above , then the truck towing it must display the DOT #.
The form available on line , by fax or US mail is confusing at first , but explains in detail the regulations and how to fill out the form .
The form is available online: www.safersys.org/
The explanation of the new regulation for New York is here : www.saferfmcsa.dot.gov
The phone number is : 1-800-832-5660
I made copies of the form (#MCS-150) along with the instructions and regulations if any one in New York needs them .

Sorry for the bad news but thats the poop on all this .

  • Ed,
Thats an excellent question . I suppose the rental companies (Uhaul and similar) will also have to file for DOT #'s in the state where the vehicle is registered if applicable.
I looked on the form and instructions for NYS , and low and behold there is a column and check box in the classification catagory for Authorized For Hire (Rental or Lease). Seems NYS is covering all bases on this one .
Keep in mind this a federal law (US Department of Transportation) DOT , Federal Motor Carrier Safety Administration .

I asked NYS (Albany) a question......
I operate this vehicle in NY only , but if I had to for a special situation , travel to, for example to New Jersey does the vehicle have to display a New Jersey DOT # as well ?
The answer was that your vehicle would be classified as an INTERSTATE motor carrier then and not as an INTRASTATE motor carrier. Different classifications but some neighboring states will allow use of the same DOT # your issued in your home state , but, then you must file with that State if applicable , and display your DOT # with both states abbreviations.

    Example : USDOT 123456 NY,NJ

If the neighboring states have different regulations , than you must file in each state and display each states DOT #'s seperately . Very much like we all have see on open road tractor trailers that have several different USDOT #'s displayed on their rigs .

    Hope this helps,
    Ken Resnick
